Tomely — Terms of Use

1. Agreement
These Terms govern your use of Tomely (listed on the App Store as "Tomely: Med Reminders"), a personal medication reminder and tracking app developed and sold by Gabriel Barca, an individual developer based in Brazil ("we", "us").
By creating an account or using the app, you accept these Terms. If you do not agree with them, do not use the app.
2. Tomely is not a medical device — read this
Tomely is an organizational tool, not a medical service.
- It does not provide medical advice, diagnosis or treatment, and it is not a substitute for a healthcare professional.
- It does not check dosages, interactions or contraindications. It reminds you of what you entered.
- Always follow the instructions of your doctor or pharmacist. Never start, stop or change a medication because of anything you see in this app.
- Reminders depend on your device: the operating system, battery saving modes, notification permissions, "do not disturb", airplane mode, a discharged battery or a system update can delay or suppress a notification. Do not rely on Tomely as your only way of remembering a critical medication.
- In an emergency, contact your local emergency service.
3. Eligibility
You must be at least 16 years old to create an account and use Tomely. By using the app you confirm that you meet this requirement.
4. Your account
- Provide a valid e-mail address and keep your login details confidential.
- You are responsible for everything that happens under your account.
- One account is for one person. Do not share credentials.
- Tell us at [email protected] if you suspect unauthorized access.
- You can delete your account at any time in Settings → Delete account. Deletion is permanent: your medications and dose history are erased and cannot be recovered.
5. Acceptable use
You agree not to:
- use the app for anything unlawful, or to provide medical advice to others;
- attempt to access accounts, data or systems that are not yours;
- copy, decompile, reverse engineer or resell the app, except where the law expressly allows it;
- interfere with the service, overload the servers, or circumvent plan limits or purchase verification;
- upload content that is illegal or that infringes someone else's rights.
We may suspend or terminate an account that breaks these rules. Where the breach is minor and fixable, we will warn you first whenever it is reasonable to do so.
6. Free plan and Premium
Free plan. You can create up to 3 medications, receive reminders, and edit or delete what you created, at no cost. The limit applies only to creating a new medication — medications you already have remain fully usable.
Premium. Premium removes the medication limit and unlocks all features. It is offered in three forms:

Prices are set and displayed by the Apple App Store and Google Play in your local currency, including applicable taxes. All purchases are processed by those stores; we never receive your payment details.
6.1 Subscriptions: auto-renewal, trial and cancellation
- Title and length: "Premium Monthly" renews every month; "Premium Annual" renews every 12 months.
- Price: shown on the paywall and confirmed by the store before you pay, in your local currency.
- Auto-renewal: subscriptions renew automatically at the end of each period, and your store account is charged for the next period, unless you cancel at least 24 hours before the current period ends.
- 7-day free trial: new subscribers get 7 days free. If you do not cancel at least 24 hours before the trial ends, it converts into a paid subscription at the price shown. Any unused part of a free trial is forfeited if you buy a subscription before the trial ends.
- How to cancel: in the store, not in the app — iOS: Settings → your name → Subscriptions; Android: Google Play → Profile → Payments & subscriptions → Subscriptions. Cancelling stops the next renewal; you keep Premium until the end of the period you already paid for.
- Deleting the app does not cancel a subscription.
6.2 Premium — one-time purchase
The one-time purchase is a single payment that grants Premium without any renewal and without any further charge.
What "permanent access" means: permanent access means access for as long as Tomely is offered. If the service is discontinued, users will be notified at least 90 days in advance and will be able to export their data (medications and dose history) before shutdown. Apple/Google refund rules apply to store purchases.
We will not revoke a one-time Premium purchase, except where the store reverses or refunds the underlying transaction.
6.3 Refunds
Purchases are made through the Apple App Store or Google Play, so refunds are handled by them, under their policies:
- Apple: request a refund at https://reportaproblem.apple.com.
- Google Play: request a refund at https://play.google.com/store/account/orderhistory.
We cannot issue refunds for store purchases ourselves, but write to [email protected] and we will help you with the request. This does not affect any statutory right of withdrawal or refund you have under the consumer law of your country.
7. The service, and changes to it
We work to keep Tomely available and reliable, but we do not promise uninterrupted service. We may add, change or remove features, and we may perform maintenance. If we make a change that materially reduces what you paid for, we will tell you in advance.
Discontinuing the service is covered by the 90-day notice and data export commitment in section 6.2.
8. Your content and our content
The medications, schedules and dose history you enter are yours. You grant us only the limited permission needed to store and process them so the app can work, as described in the Privacy Policy.
The app itself — its code, design, name and logo — belongs to us and is protected by copyright and trademark law. These Terms do not transfer any of those rights to you; they give you a personal, non-transferable, revocable licence to use the app.
9. Limitation of liability
To the extent permitted by law:
- Tomely is provided "as is". We do not warrant that reminders will always be delivered on time or at all, since delivery depends on your device and its settings.
- We are not liable for indirect, incidental or consequential damages, or for missed doses, health consequences, or decisions taken based on the app.
- Where liability cannot be excluded, our total liability is limited to the amount you paid us for Tomely in the 12 months before the event.
Nothing in this section limits liability that cannot be limited by law, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or the mandatory rights of consumers — such as the rights granted by the Brazilian Consumer Protection Code (CDC) or by consumer legislation in the EU, the UK and other countries.
10. Privacy
How we handle your data is described in the Privacy Policy, which forms part of these Terms.
11. Changes to these Terms
We may update these Terms. The date at the top always shows the current version. For material changes we will notify you in the app or by e-mail before they take effect; continuing to use Tomely after that means you accept the new Terms. If you do not accept them, you may delete your account.
12. Governing law and jurisdiction
These Terms are governed by the laws of Brazil, and disputes may be brought before the courts of the developer's domicile in Brazil.
This does not deprive you of the protection of the mandatory consumer rules of the country where you live, nor of the right to bring proceedings before the courts of your own country where the law gives you that right. Brazilian consumers may also sue in the courts of their own domicile, under article 101 of the CDC.
